BREEDING CONTRACT FOR THE STALLIONS

OF

SANKT GEORG FARM INTERNATIONAL

This agreement made on ___________________, 20___ by and between, Margret Gafford (Stallion and Farm owner) and _________________________ (Mare Owner).  

  1. Stud Fee:  ___________________ ($___________) for __________________.

  1. All mares must have a recent uterine culture free of infection and be up to date on all vaccinations recommended by the veterinarian used by the farm and worming.  A culture may be done upon arrival at the owner’s expense.  The Mare Owner is responsible for all veterinary care and procedures relating to the breeding inclusive of ultrasound. 
  2. Payment:  Mare Owner agrees to pay said money on the dates indicated below: 
    1. Booking Date:  ____________Deposited Amount: __________.  The deposited amount is forfeited if mare does not arrive at the farm by _______________ and prior arrangements with the farm owner have not been made. 
    2. STUD FEE OF $___________ IS DUE ON OR BEFORE ARRIVAL OF MARE AT FARM.  FAILURE TO REMIT FEE WILL FORFEIT BOOKING DATE AND DEPOSIT.
    3. Date of pick-up of mare from farm:  Vet fees (if any), Mare care (see below), and Stud fee balance of _____. 
  1. Care and Feeding of Mare:  In addition to the above breeding charge, Mare Owner agrees to pay the following:  _______ dollars per day for feed and stall; _____ dollars per day for “wet mare” (mare with foal at side).  This fee includes boarding cost.  In the event a mare and or foal will remain more than 10 days a boarding contract must be signed
  1. Live Foal Guarantee:  In the event the Mare’s Owner’s mare does not take and become in foal, Stallion Owner agrees to breed that same mare again for no cost of additional stud fee consideration at any time during the same or the next breeding season at the Mare Owners request after the mare has been veterinary checked and treated for genital tract infections if present.  Mare Owner will be responsible for additional chute fees, presenting evidence of current vaccinations and mare care fees.  (“Live Foal” meaning able to stand and nurse for at least forty-eight (48) hours after birth).  Mare Owner is required to give the recommended vaccinations during gestation.  Mare Owner is encouraged to prevent the mare’s ingestions of fescue grass or hay for at least three months prior to expected delivery date of foal. In the event that said mare does not deliver a live foal, Stallion Owner agrees to give Mare Owner the right to an additional service to said mare at any time within one year from the last date of breeding said mare under this agreement.  Stallion Owner shall have no further liability hereunder for servicing said mare.  A substitute mare may be used if said mare is found infertile or dies before she settles.  Owner of substitute mare will still be responsible for meeting all the terms of the breeding contract. 
  1. Veterinarian Certificates:  Mare Owner warrants that said mare is free from disease or infection that could be transmitted to other horses, and agrees to provide upon arrival at the farm, a veterinarian certificate showing freedom from disease or infection.  This shall include proof of a negative Coggins test for EIA within one year of arrival at the farm.  Stallion Owner reserves the right to reject any mare that she deems in poor condition or one that is she deems unmanageable or a danger to the stallion or her staff.  Mares that are not halter broken will not be accepted.
  1. Veterinarian Care:  The Stallion Owner agrees to use reasonable care and caution for said mare while in her possession or control, pursuant to this agreement, and is authorized to obtain the necessary reasonable veterinarian as required, but only after taking steps to contact the Mare Owner without success.  Any resulting fees from such emergency will be the responsibility of the Mare Owner.  The Mare Owner agrees that said mare may be sedated and/or hobbled in accordance with prescribing veterinarian guidelines if necessary to insure safety during the breeding process.
  1. Risk of Loss and Hold Harmless:  Mare Owner hereby releases the farm and farm owner from any responsibility or liability for any disease, injury or accident to the mare or accompanying foal resulting from negligence.
  1. Termination:  Either party may terminate this Agreement for failure of other party to meet any material terms of this agreement.  In the case of any default by one party, the wronged party shall have the right to recover reasonable attorney’s fees and court costs as a result of said default.  In the event the Stallion dies, or in any way becomes unfit for breeding, then the booking contract becomes null and void and any deposits will be returned.
  1. Right Of Lien:  Mare Owner is put on notice that the Farm Owner has and may assert and exercise the right of lien, as provided by the State of Virginia for any amount due for the board and keep of horse(s) and also for the storage or other charges due hereunder and further agrees the Farm Owner shall have the right without process of law to attach a lien to your horse(s) after two (2) months of non-payment or partial payment and can then sell horse(s) to recover its loss.

This agreement is governed and shall be construed under the laws of the state of Virginia.

At this time the farm uses the following veterinarian to provide emergency and routine care:

**** Please note:  A handling fee of $150.00 dollars is due at the time of the mare’s arrival at Sankt Georg Farm.  This fee is charged to cover the cost of additional personnel  required to assist in the breeding process.
